Lalita Sundari Enterprises Inc., doing business as Build Business AI ("we," "us," or "our"), provides Application-to-Person (A2P) messaging services for businesses. By using our services, you ("Customer" or "User") agree to comply with these Terms and Conditions (T&C) and all applicable laws, including TCPA, CTIA, GDPR, and other messaging regulations.

1. Service Description

Build Business AI enables businesses to send automated, transactional, and promotional messages via SMS, WhatsApp, and other messaging channels.

2. Customer Responsibilities

2.1 Compliance with Messaging Laws

Customer agrees to comply with all A2P messaging regulations, including but not limited to:

TCPA (Telephone Consumer Protection Act) – Prior express written consent for promotional messages.

CTIA Guidelines – Adherence to carrier best practices.

GDPR (if applicable) – Proper consent mechanisms for EU users.

DNC (Do-Not-Call) Lists – Scrubbing against opt-out databases.

2.2 Proper Consent & Opt-Out Management

Customer must obtain prior opt-in consent from recipients before sending promotional messages.

Customer must honor opt-out requests (STOP, UNSUBSCRIBE) immediately and maintain suppression lists.

Customer must provide clear sender identification and contact information in all messages.

2.3 Prohibited Content

Customer must not send messages containing:

Illegal, fraudulent, or deceptive content.

Spam, phishing, or malware.

Harassment, hate speech, or adult content.

Unauthorized telemarketing (without proper consent).

3. Build Business AI’s Rights & Obligations

3.1 Message Review & Enforcement

We reserve the right to review, block, or suspend messages that violate policies.

We may terminate service for repeat violations without refund.

3.2 Service Availability & Limitations

We strive for uptime but do not guarantee 100% delivery due to carrier restrictions.

Message delivery speeds may vary by region and carrier.

4. Fees & Billing

Customer agrees to pay all fees as per the selected pricing plan.

Refunds are not provided for service suspensions due to policy violations.

5. Data Privacy & Security

We process data per our Privacy Policy (linked above).

Customer is responsible for securing their own data and ensuring compliance with privacy laws.

6. Limitation of Liability

Build Business AI is not liable for:

Message delivery failures due to carrier issues.

Customer misuse of the service.

Indirect damages (lost profits, data loss).

7. Termination

Either party may terminate service with 30 days’ notice.

We may immediately suspend service for violations.

8. Governing Law & Disputes

These T&C are governed by the laws of [Insert Jurisdiction, e.g., Delaware, USA].

Disputes shall be resolved via arbitration (if applicable).

9. Changes to Terms

We may update these T&C with 30 days’ notice (via email or dashboard alerts).
